A Temporary Resident Permit (TRP) for victims of family violence, or in some cases other immigration classes, is a special permit to ensure that vulnerable foreign nationals do not lose their immigration status on leaving an abusive spouse or common-law partner.
This permit is available to applicants of the family class or spouse or common-law partner in Canada class who have left their sponsor due to abuse, or have not yet left because they are afraid of losing their immigration status. An open work permit application can be submitted at the same time as the family violence TRP.
Violence or abuse can take various forms:
Physical abuse, including forcible confinement
Sexual abuse, including sexual contact without consent
Psychological abuse, including threats and intimidation
Financial abuse, including fraud and extortion
Neglect, including the failure to provide the necessaries of life
You may be eligible for this permit, if your abusive sponsor has withdrawn a family class or SCLPC class sponsorship application, you have been lied to by an abusive sponsor that your application has been submitted and is in process, when it has not been, or if you are going to apply for permanent residence through a relationship that has become abusive.
If you or someone you know is uncertain about their status in Canada, we may be able to help. Email us at abhatti@ab-legal.ca or call 438-264-0182.
